Successful Defense of Insurance Broker

Western Brokers adv. Government of American Samoa Our client was sued for negligence in the procurement of a $45 million insurance policy covering the property of the Government of American Samoa, including schools, bridges, etc. It was alleged that our client was negligent in not pointing out that the policy had an exclusion for wind-driven water (i.e., hurricanes). After a hurricane devastated the island, the insurance carrier, Affiliated FM, denied coverage. In the ensuing trial, we obtained a defense verdict on behalf of Western Brokers. The insurance company, however, did not fare as well and had judgment entered against it in an amount in excess of $88 million.
